1. Introduction

These Terms of Service (“Terms”) govern the use of the website, services, and yacht charter brokerage activities provided by BnG Solutions FZ-LLC, operating under the commercial brand Bellamy Yachts.

By making an enquiry, communicating with us, or using our services, you agree to these Terms.

Bellamy Yachts acts solely as an intermediary/broker, not as a yacht owner or charter operator.

2. Legal Entity

Bellamy Yachts is a trading name of:

BnG Solutions FZ-LLC
RAKEZ Free Zone, Ras Al Khaimah, UAE
License Type: FZ-LLC
Activity: Project Management Consultancy / Marketing Management

All brokerage and facilitation services are performed under this legal entity.

3. Our Role as Broker

3.1 We do not own, manage, or operate any yacht or vessel.

3.2 We act solely as an introducer, facilitator, and intermediary between clients (“you”, “your”) and independent third-party yacht operators (“Operators”).

3.3 When booking a yacht through Bellamy Yachts:

• You enter into a direct contract with the selected Operator

• The Operator is solely responsible for the execution of the charter

• The charter is governed entirely by the Operator’s Terms & Conditions

3.4 Bellamy Yachts is not responsible for:

• yacht operations

• safety procedures

• crew conduct

• vessel compliance

• itinerary decisions

• cancellations or delays imposed by the Operator

• incidents occurring onboard

Our responsibility is limited to presenting options and coordinating communication.

4. Applicability of Operator Terms & Conditions

4.1 All bookings are subject exclusively to the Terms & Conditions, cancellation policies, safety rules, refund policies, and payment structures of the Operator.

4.2 These policies vary between Operators and may include strict no-refund rules.

4.3 Prior to finalizing a charter, you will be provided with or given access to the Operator’s Terms & Conditions, which must be accepted via our booking system (e.g., WeTravel).

4.4 In case of conflict between:

• these Terms, and

• the Operator’s Terms & Conditions

the Operator’s Terms prevail for all matters involving the yacht and the charter service.

5. Booking Process

5.1 A booking becomes binding only when:

• the Operator confirms availability, AND

• the required payment(s) are received, AND

• the Operator’s Terms & Conditions are accepted

5.2 Information provided on our website, social media, or marketing materials is for general guidance and may differ from final Operator documentation.

5.3 Prices, availability, vessel specifications, and itineraries are subject to change by the Operator without prior notice.

6. Payments

6.1 Depending on the arrangement with the Operator, payments may be:

• processed directly by the Operator, or

• collected by Bellamy Yachts as an intermediary/collection agent and forwarded to the Operator

6.2 Bellamy Yachts may apply internal service, facilitation, or brokerage fees included in the final price presented to the client.
We are not obligated to disclose our internal pricing structure or commercial agreements.

6.3 Refunds, cancellations, or compensation are governed solely by the Operator’s policies.
Bellamy Yachts cannot refund amounts that have already been transferred to the Operator.

7. Cancellations & Refunds

7.1 Bellamy Yachts does not determine cancellation or refund policies.

7.2 All cancellation, refund, amendment, and rescheduling rules are exclusively those of the Operator.

7.3 Many Operators apply:

• strict no-refund policies, or

• cancellation fees based on timing, or

• non-refundable deposits

7.4 By booking, you acknowledge that:

• refunds are not guaranteed

• changes may incur penalties

• operator rules override any expectation of refund

7.5 Bellamy Yachts will assist in communicating with the Operator but is not responsible for their decision.
7.6 Broker Notice – Cancellation & Refund Policy

All cancellations and refunds are governed exclusively by the Terms & Conditions of the yacht operator providing the vessel.
Bellamy Yachts (BnG Solutions FZ-LLC) does not determine or control refund policies and cannot issue refunds on behalf of operators.
Any cancellation request will be forwarded to the operator, whose decision is final.

8. Responsibilities of the Client

By making a booking, you agree to:

• provide accurate personal details

• comply with the Operator’s Terms & Conditions

• respect all safety instructions from crew and captain

• ensure all guests follow rules onboard

• arrive on time for charter departure

• avoid dangerous, illegal, or disruptive behavior

The captain has full authority at all times.

9. Limitation of Liability

To the fullest extent permitted by UAE law:

​

Bellamy Yachts / BnG Solutions FZ-LLC is NOT liable for:

• accidents, injuries, loss, or damage onboard

• weather-related changes or cancellations

• itinerary modifications

• mechanical issues

• crew decisions

• port authority decisions

• Operator negligence

• delays or operational disruptions

• loss of personal belongings

Our liability is limited solely to:

• the role of intermediary,

• with a maximum liability equal to our earned brokerage fees for that booking.

We are not liable for any indirect or consequential loss (including loss of enjoyment or missed events).

10. Third-Party Operators

Yachts are operated by independent companies licensed in the UAE.
We have no control over:

• their maintenance

• their insurance

• their staffing

• their maritime compliance

• their internal policies

You agree that all operational responsibilities rely entirely on the Operator.

11. Data Protection

Personal data is collected and processed according to our Privacy Policy.
We may share data (e.g., passport copies, guest lists) with Operators strictly for the purpose of completing your booking.

12. Force Majeure

We are not liable for events outside our control, including:

• weather

• port closures

• government restrictions

• safety concerns

• technical breakdowns

• operational decisions made by the captain or Operator

13. Governing Law

These Terms are governed by the laws of the United Arab Emirates.
Any dispute related solely to brokerage services shall be resolved in the courts of Dubai, UAE.

14. Changes to These Terms

We may update these Terms at any time.
The latest version will always be available on our website.
